Terms of Service for Participants

These Terms of Service govern the use of Veloxshot by event participants and buyers of photographs and video clips.

Acceptance

By creating an account or using Veloxshot as a participant, you agree to these Terms. If you do not agree, do not use the service.

The Service

Veloxshot is a marketplace that allows you to:

• Search for photographs and, where available, video clips of events in which you participated.
• Purchase and download the photographs and clips in which you appear.
• Search by bib number, facial recognition (selfie), or by browsing event galleries.
• View albums that a photographer has shared with you through a share link, and share the results of your selfie search with others through a link.

Video clips. Where an event or album has race video, Veloxshot can show you short previews of the moments in which you appear and offer you the corresponding clip for purchase. Clips are available in event albums and, in private albums, through whole-album share links when the album is priced in Mexican pesos (MXN).

The photographs and videos belong to the photographers or other rights holders who uploaded them. Veloxshot facilitates the search and purchase; each purchase is a transaction between you and the photographer or rights holder, with Veloxshot acting as the technological intermediary.

Selfie-Based Search and Biometric Data

The selfie-based search uses Veloxshot's own facial recognition technology. To use this feature, you must provide your express and separate consent before your first search. Your selfie is used only to perform the search, comparing it against the facial data of the photographs and, where available, the race videos of the event or album you are searching, and it is deleted immediately after the search. We keep a log of each search (a reference to your consent, the event, IP address and number of results); 180 days after the search, the IP address and the link to your consent are removed, as described in the Privacy Notice.

Minors

Veloxshot prohibits the use of the selfie-based search by individuals under 18 years of age without the express authorization of their parent or legal guardian. By using the selfie search, you declare and attest that you meet this requirement. Responsibility for non-compliance with this restriction rests with the parent or legal guardian.

Withdrawal of Consent

You can withdraw your consent to the processing of biometric data at any time via the Privacy preferences link in the website footer. The withdrawal takes effect immediately.

Purchases

• Prices are displayed in the currency shown on the album and at checkout. Payments are processed via Stripe.
• Upon a completed purchase, you will receive download access to the acquired photographs and clips. If you purchased while signed in, you can download them from your account for as long as your account exists.
• For guest purchases (without an account), download access is granted via a tokenized link sent by email.
• Photographs are delivered in high resolution, without a watermark, for personal use.
• Clips are prepared after the purchase; delivery of a clip may take a few minutes while it is generated. Clips are delivered for personal use.

Refunds

Photographs and clips are digital products delivered by download. Once a purchase is completed and the download has been made available, it is not refundable.

If a download link does not work, if you received the wrong photographs or clips, or if a charge does not look right to you, contact us.

Permitted Use

You may:

• Download and keep the purchased photographs and clips for personal use.
• Share the photographs and clips on your personal social media accounts.
• Print the photographs for personal use or as a gift.

You may NOT:

• Resell or sublicense the photographs or clips.
• Use the photographs or clips for commercial purposes (advertising, merchandise, etc.) without additional authorization from the photographer or rights holder.
• Alter the photographs or clips to falsify identity or commit fraud.

Reporting Content

If you believe a photograph, video or preview, including one used in Veloxshot's marketing, violates your right to your image, privacy, or the rights of third parties, you can request its review and eventual removal by writing to legal@veloxshot.com. Veloxshot will review the request and, when appropriate, suspend the visibility of the content while it is being investigated.

Limitation of Liability

Veloxshot facilitates searches and purchases; it is not the owner or ultimate custodian of the photographs and videos. Responsibility for the content and image rights rests primarily with the photographer or rights holder (see Photographer Agreement).

Account and Security

• You are responsible for maintaining the confidentiality of your credentials.
• Notify us immediately of any unauthorized access to your account.

Termination and Account Deletion

You can delete your account at any time from your account profile. Veloxshot may suspend accounts that engage in abuse, fraud, or misuse of the service.

When you delete your account, Veloxshot anonymizes it: your login is deleted and your personal data is removed from your account, while the records of your orders are kept for tax, accounting and legal purposes, as described in the Privacy Notice.

Important: after you delete your account, you will no longer be able to access, from an account, the photographs and clips you purchased while signed in. Download them before deleting your account. Download links received by email for guest purchases keep working.

Amendments

Veloxshot may update these Terms. We publish each new version on this page; if you have an account, you will be asked to accept the new version the next time you use Veloxshot while signed in.
